Previous News  Next News - No Stucco Class Action Exists

Some Sun City Hilton Head homeowners have inquired about stucco “class action” in the community. In an effort to keep you informed, Del Webb / Pulte would like to provide you with current and accurate information.

First, there is no stucco class action at this time. An arbitration process related to stucco was initiated by a single Sun City Hilton Head homeowner against Del Webb / Pulte in 2006. In that case, the homeowner (plaintiff) alleged that certain defects in the stucco system on his home caused his stucco to crack. In response to these allegations, Del Webb / Pulte initiated an investigation to determine why the stucco on the plaintiff’s house is cracking. This type of investigation, when it is part of a litigation process, is more complex and time-consuming than it would be under normal circumstances. Fortunately, our investigation to date has not yielded any evidence of a widespread stucco issue in the community.

In addition to making claims about his own house, the plaintiff has indicated that he may make a motion that could expand the current arbitration process into a class action. With such a motion, the plaintiff would seek to represent other homeowners in Sun City Hilton Head with regard to the stucco on their houses. Until such a motion is made by the plaintiff and granted by the arbitrator, the arbitration will continue to involve only one home. And since there is no evidence of a widespread stucco issue, Del Webb / Pulte intends to oppose any motion that would expand this process into a class action.

Please be assured that the arbitration process has not caused us to change our policy of promptly responding to homeowner questions and concerns. As always, when a homeowner contacts us with a complaint about their stucco, we will go to the home to determine if the stucco system is performing in accordance with our warranty. If we see that a problem exists and is covered by warranty, we will respond accordingly and remedy the problem.

Lastly, as with all aspects of your home, we encourage you to regularly inspect the stucco on your home. Please remember that small cracks in your stucco (1/8th of an inch or smaller) are expected and are not normally considered to be a problem.
